These Terms and Conditions (“T&C”) set forth the legally binding framework between you (“User,” “You,” or “Your”) and iUttarakhand, owned and operated by
Earthly Hospitality Services Private Limited (“Company”, “we”, “our”, or “us”), for:
- Accessing/using iUttarakhand’s website(s), mobile applications, or other channels (collectively, “Platform”).
- Booking any experiences, treks, homestays, tours, or related services through iUttarakhand.
By using the Platform, creating an account, or making any booking, you acknowledge that you have read, understood, and agreed to these T&C. If you do not agree, please discontinue use immediately.
1. Definitions
- User, You, Your: Any person visiting, accessing, registering on, or making a booking through the Platform.
- Booking: Any confirmed purchase or reservation for an activity, trek, homestay, or tour package.
- Supplier or Third-Party Supplier: The entity providing the service, such as homestays, trek operators, transport providers, or activity organizers.
- Services: All offerings booked through iUttarakhand, including treks, homestays, experiences, or activities.
- Quotation/Booking Confirmation: The formal confirmation containing service details, inclusions/exclusions, schedule, price, cancellation terms, and payment deadlines.
- Platform: iUttarakhand’s websites, apps, partner pages, social media accounts, and affiliated channels.
- User Content: Any text, images, feedback, videos, or materials posted by the User on or through the Platform.
- Force Majeure: Events beyond our control, including natural disasters, pandemics, political unrest, or other unforeseen circumstances.
2. Legal Agreement & Booking Contract
- You confirm you are at least 18 years old and authorized to enter a binding contract.
- If booking on behalf of others (e.g., minors, family, friends), you are responsible for their compliance with these T&C.
- The final Quotation or Booking Confirmation forms the legally binding contract. Verbal commitments or previous communications are non-binding.
- iUttarakhand generally acts as a facilitator; actual services are provided by independent suppliers.
3. Booking Policies
- Booking is confirmed only upon payment and receipt of a Booking Confirmation.
- You are responsible for providing accurate personal information (names, ages, IDs, contact details). Errors may result in denied participation or additional charges.
- Cancellations, refunds, and modifications are governed by supplier-specific policies and outlined in the Quotation.
4. Guest Responsibilities & Trip Guidelines:
1. Program Timings:
Adherence to scheduled timings is crucial. Missed services or activities are non-refundable.
2. Photo Identification:
All guests above 18 must present valid government-issued photo ID (Aadhaar, Driver’s License, Voter ID, Passport) at the start of the trip. Guests without valid ID will not be allowed to begin the trip.
3. Itinerary Adjustments:
iUttarakhand may adjust itineraries due to external factors or unforeseen circumstances without altering the overall experience. Any changes will be communicated promptly.
4. Additional Expenses:
Personal expenses such as extra meals, snacks, laundry, room service, or amenities not listed in the inclusions are not covered. Homestays or service providers will charge guests directly.
5. Medical Documentation:
Travelers should carry medical documentation if applicable for pre-existing conditions or medications.
6. Unforeseen Costs:
Unexpected costs arising from natural events, political disruptions, or external circumstances are the responsibility of the guest.
7. Clothing & Acclimatization:
Guests should bring weather-appropriate clothing and acclimate gradually for high-altitude activities or treks.
8. Safety Instructions:
Guests must follow all instructions from guides, facilitators, and local staff for their safety and the smooth execution of activities.
5. Liability & Indemnification
- iUttarakhand is not liable for personal injury, loss, theft, or delays caused by suppliers, co-travelers, or external factors.
- Users agree to indemnify iUttarakhand against claims arising from violation of T&C, laws, or third-party rights.
- Force majeure events absolve iUttarakhand of liability, except to the extent suppliers provide refunds or alternatives.
6. Data & Privacy
- User data is collected, stored, and processed in accordance with iUttarakhand’s Privacy Policy.
- Data may be shared with third-party suppliers for operational purposes but will not be sold or used commercially beyond service facilitation.
- Users consent to transactional communications (email, SMS) per applicable regulations.
7. Intellectual Property
- All logos, designs, text, images, and software are the property of iUttarakhand or licensed to it.
- Users may not reproduce, distribute, or use intellectual property without permission.
8. Governing Law & Dispute Resolution
- These T&C are governed by Indian law.
- Jurisdiction is limited to courts in Delhi, India.
- Arbitration clauses, if stated in the Quotation, govern dispute resolution.
9. Amendments & Updates
- iUttarakhand may update T&C at any time. Continued use constitutes acceptance.
- Users will be notified of significant changes via email or Platform announcements.
